NOTICE program summary

The NOTICE  program stands for "Neighborhoods Organized to Initiate Codes Enforcement" and it is designed to help citizens identify and report codes violations in their neighborhoods. The NOTICE program allows citizens to assist in the identification of codes violations enabling them to become a direct participants in the process that helps improve and maintain their own neighborhood.

If you are a concerned neighbor, and have a property that you would like the RNA NOTICE  team to inspect, please send an e-mail and let us know about it. Please include the house NUMBER and street name and please be as specific as possible about your concerns. That way we will know what to look for when we go out to inspect.

The NOTICE inspection team is made up of volunteers from our neighborhood that have been through a training class with the Metro Codes Department. Part of the training involves what we can inspect and report and what we cannot. Below is a list of things that the NOTICE team can report.

  • Trash/Debris in yard (All exterior property and premises shall be maintained in a clean, safe and sanitary condition. It is unlawful to utilize a premises for open storage of any appliance, discarded mattresses, box springs, building material, rubbish, tires, automotive parts, junk, or debris. Art. V., sec 16.24.330 (B))

Stated simply: You cannot let trash of any kind accumulate on your premises--including building materials.

  • Inoperable /Unlicensed Vehicle (Except as otherwise may be permitted by the Zoning Code, inoperable, unlicensed or unregistered motor vehicles shall not be openly parked, kept or stored on any premises. Art. V., sec 16.24.330 (K))

Stated simply: If you have a vehicle parked openly on your property, it must be both operable and licensed.

  • Vehicle(s) parked in yard (Every motor vehicle located on private property shall be  either stored inside a fully enclosed structure or similarly enclosed area designated and approved for such purposes, or parked or stored in a safe manner on a paved or graveled area, other than a sidewalk (except vehicles with a valid handicapped tag or sticker). Art. V., sec 16.24.330 K(3))

Stated simply: Motor vehicles CANNOT be parked on the grass. This includes motor homes. Cars and motorized vehicles have to be parked on a paved or graveled surface.

  • Inoperable/Discarded Appliances and Furniture in yard (All exterior property and premises shall be maintained in a clean, safe and sanitary condition. It is unlawful to utilize a premises for open storage of any appliance, building material, rubbish, tires, automotive parts, junk, or debris. Art. V., sec 16.24.330 (B))

Stated simply: You cannot keep indoor furniture or appliances stored outside. You also cannot use indoor furniture as outdoor furniture (on porches, for example).

  • Unsanitary Conditions in yard (Every dwelling and every part thereof shall be kept clean and free from any accumulation of dirt, filth, rubbish, garbage, or similar matter, and shall be kept free from vermin or rodent infestation. All yards, lawns and courts shall be similarly kept clean and free from rodent infestation. Chapter 10-36-020)

Stated simply: You cannot let garbage accumulate in your yard.

  • Graffiti (It shall be the duty of the owner of any building, structure, and/or real property on which the building or structure is located to restore said surface to an approved state of maintenance and repair. Art. V., sec 16.24.340 ((T)).

Stated simply: No graffiti. It is the property owner's responsibility to remove any graffiti on their property.

THINGS THAT NOTICE CANNOT REPORT:

Any structural damage to a property. If the house has a lot of problems like rotten trim, broken windows, falling gutters, or is in need of any other structural repairs, then a report must be filed with Codes by calling or e-mailing.

Structural damage must be assessed by a qualified codes inspector. If there is a house on your block that needs to be checked by a codes inspector then please call 862-6516 or email Bill Penn at Codes at bill.penn@nashville.gov

Overgrown grass, weeds, shrubs cannot be reported via the NOTICE program. This falls under the jurisdiction of the Health Department.

You can call 340-5644 to report problems with overgrown yards.

However, if the property is OWNER OCCUPIED, the Health Department can only send out a letter requesting that the owner mow the yard, but if they do not comply the Health Department can do nothing further.

If the house is a RENTAL and is occupied by a tenant, a letter will be sent to the owner and he is REQUIRED to maintain the yard. If he doesn't mow the yard in the designated amount of time, it will turned over to public works to be cut and the owner will be sent a bill.

If the house has been ABANDONED, you must call and report it to the Health Department. You can call 340-5644 to file the report. It takes approximately 2-3 months to resolve abandoned property cases.
